Obtaining by the Investor of a building permit
Once received the conclusion on compliance (positive conclusion) of the project documentation with requirements of technical regulations and the results of engineering surveys, requirements to the sections of project documentation, as well as on compliance of results of engineering surveys to the requirements of technical regulations, Investor/Developer must obtain a building permit - a document confirming compliance of the project documentation to the requirements of the city development plan of land parcel and giving to the developer the right to carry out the construction, reconstruction of capital construction objects, as well as their general overhaul.
Building permit for the land parcel is issued by the local government based on the location of such land parcel (see Appendix 1).
Building permit for the land parcel on which the Town-planning regulation doesn’t affect or for which Town-planning regulation cannot be established, is issued by the federal executive authority, executive authority of the Russian Federation subject or by the local authority in accordance with their competence.
Investor/Developer sends to an authorized to issue building permits authority an application with following documents attached:
- Legal documents of the land parcel;
- City development plan of a land parcel;
- Materials contained in the project documentation:
- Explanatory note;
- Scheme of planned organization of the land parcel, made in accordance with City development plan of a land parcel, with the designation of the capital construction object location, entrances and walkways to it, boundaries of zones of public easements, objects of archaeological heritage;
- Scheme of planned organization of the land parcel, confirming the location of the linear object within the red lines, approved as part of documentation on planning of territory in respect to the linear objects;
- Schemes that reflect architectural solutions;
- Information on engineering equipment, summary plan of networks of engineering and technical support with designation of places of connection of projected capital construction object to the networks of engineering and technical support;
- Project of organization of building of capital construction objects;
- Project of organization of works on demolition or dismantling of capital construction objects, their parts;
- Positive conclusion of the state examination of project documentation, positive conclusion of the state ecological expertise of project documentation;
- Permission on deviation from the limiting parameters of permitted construction, reconstruction;
- Agreement of all right holders of capital construction object in the case of reconstruction of such object.
Authorized executive authority to issue building permits within 10 (ten) days from the day of receipt of application for a obtaining a building permit:
- Carry out the presence of documents, attached to the application;
- Carry out inspection of compliance of the project documentation or scheme of planned organization of the land parcel with designation of location of the object of individual housing construction to the requirements of the city development plan of a land parcel, to the red lines. In case of issuance to the person of permission on deviation from the limiting parameters of permitted construction, reconstruction, is carried out inspection of the project documentation or specified scheme of planning organization of the land parcel for compliance with the requirements established in the permit for deviation from the limiting parameters of permitted construction, reconstruction;
- Issue of a building permit or refuse to issue such a permit with statement of the reasons for refusal.
